Terms and Conditions of Sale

NATUR’ALL HAIR – Effective as of January 1, 2025

1. Preamble

The company NATUR’ALL HAIR, with registered office at 1 avenue Henri Dunant – 98000 MONACO, registered with the Monaco Trade and Industry Register (RCI No. 25P10699), and EU VAT number FR 57 00018 6352, operates the website www.naturallhair.fr (hereinafter “the Website”).

These Terms and Conditions of Sale (“TCS”) apply to all sales of products and services made by NATUR’ALL HAIR (hereinafter “the Seller”) through the Website, to both individual and professional customers (“the Buyer”) located in Metropolitan France, Monaco, and Corsica. By placing an order, the Buyer confirms full acceptance of these TCS.

2. Scope of Application

These TCS define the rights and obligations of both parties regarding the online sale of products offered by NATUR’ALL HAIR. They apply to all orders placed through the Website and supersede any other documents. The applicable version is the one published on the Website at the time the order is confirmed.

3. Products

a) Characteristics and Availability

Products are described with the greatest possible accuracy. Photographs are not contractual. Offers are valid while displayed on the Website and within available stock limits.

If a product becomes unavailable after an order is placed, NATUR’ALL HAIR will promptly notify the Buyer and offer either a replacement product of equivalent value or a full refund.

b) Use of Products

The Buyer must use the products in accordance with their intended purpose and the instructions provided. NATUR’ALL HAIR shall not be liable for improper or unsafe use.

4. Prices

All prices are shown in euros (€) including all taxes (TTC). Prices may be adjusted at any time, but confirmed orders remain at the price applicable at checkout. Shipping fees are added at checkout and shown before payment confirmation.

5. Orders

a) Customer Account

Orders can be placed by creating a customer account or as a guest. The Buyer must provide accurate and complete information. NATUR’ALL HAIR cannot be held responsible for delays or failed deliveries due to incorrect or incomplete details.

b) Order Process

  1. Select desired products and add them to the cart.
  2. Confirm the shopping cart and choose a delivery method.
  3. Accept these Terms and Conditions of Sale.
  4. Confirm and pay for the order via a secure payment method.
  5. Receive a confirmation email with order details.

Once confirmed, orders cannot be modified.

6. Payment

Payment is due immediately upon order confirmation. NATUR’ALL HAIR accepts payments via PayPal or bank transfer. The Seller retains ownership of the products until full payment is received.

In case of non-payment or payment incident, the order may be suspended or cancelled.

7. Delivery

a) Delivery Areas

Deliveries are available in Metropolitan France, Monaco, and Corsica. The Buyer must ensure the accuracy of delivery details. NATUR’ALL HAIR is not responsible for delays or losses caused by incorrect addresses.

b) Delivery Methods and Timeframes

  • Colissimo – home delivery
  • Chronopost – express delivery
  • Mondial Relay – pickup point delivery

Deliveries are made Monday through Friday. The maximum delivery time is 30 calendar days from the date of order.

c) Tracking

The Buyer will receive an email with tracking details once the package is shipped.

d) Shipping Fees

Shipping costs depend on the carrier, delivery method, and total order amount. Fees are displayed before checkout. Free delivery may apply to certain promotions.

e) Receipt of Goods

Upon delivery, the Buyer must check the package’s condition. Any visible damage (missing items, broken, opened, or damaged goods) must be reported immediately to the carrier and NATUR’ALL HAIR within 48 hours via [email protected].

f) Delays

If delivery exceeds 30 days, the Buyer may cancel the order according to Article L.216-6 of the French Consumer Code, and receive a refund within 14 days.

g) Uncollected Packages (Pickup Points)

If a package is delivered to a pickup point (e.g., Mondial Relay), the Buyer will receive a notification by email or SMS. The package must be collected within 7–10 calendar days from its arrival. After this period, it is automatically returned to NATUR’ALL HAIR.

Consequences

Returned parcels are considered delivered. Failure to collect a parcel does not constitute a withdrawal. NATUR’ALL HAIR will offer:

  • Re-shipment (at the Buyer’s expense), or
  • A refund of the product amount, excluding initial and return shipping costs.

The Buyer is responsible for ensuring correct address information and timely pickup. NATUR’ALL HAIR cannot be held liable for uncollected packages or incorrect addresses.

8. Right of Withdrawal

The Buyer has 14 days from the delivery date to withdraw without giving a reason. This right does not apply to opened or unsealed items (for hygiene reasons) or perishable goods.

Returns must be sent in perfect condition and in the original packaging to:

Refunds are processed within 14 days after receipt, using the original payment method.

9. Legal Warranties

All products are covered by the legal warranty of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code). In case of a defect, NATUR’ALL HAIR will repair, replace, or refund the product.

10. Liability

NATUR’ALL HAIR shall not be held liable for improper product use, indirect damages, or force majeure events (strikes, network failures, natural disasters, etc.). The Buyer remains responsible for the accuracy of their personal information.

11. Promotions and Discount Codes

Promotions and discount codes are valid only during the indicated period, non-cumulative, and cannot be exchanged for money. If an order is cancelled, the code cannot be reused.

12. Proof and Archiving

Electronic records kept by NATUR’ALL HAIR serve as proof of orders and communications.

14. Data Protection

NATUR’ALL HAIR processes personal data in accordance with the Monaco Law No. 1.165 of December 23, 1993 and the EU GDPR. Data is used exclusively for order management and customer support.

15. Intellectual Property

All Website content (texts, images, graphics, logos, etc.) is protected by intellectual property laws. Any reproduction, in whole or in part, is prohibited without written permission from NATUR’ALL HAIR.

16. Dispute Resolution and Governing Law

In case of a dispute, the Buyer must first contact NATUR’ALL HAIR to seek an amicable resolution. Failing agreement, the Buyer may use a consumer mediation service free of charge. If mediation fails, disputes shall fall under the jurisdiction of the Courts of the Principality of Monaco and governed by Monaco law.
